Terms and Conditions — Nathan Sixsmith Photography
Photography Consent: By hiring Nathan Sixsmith Photography you are consenting to be photographed by Nathan Sixsmith of Nathan Sixsmith Photography.
Disclaimer: Nathan Sixsmith Photography does not tolerate malicious trolling or obscene language on its Facebook or Instagram pages. Any posts suspected of trolling or containing inappropriate language will be removed and the contributor banned from any future posting.
Booking Deposit: All bookings require a 50% deposit to secure your booking date. In the event that the booking is cancelled by the booking party, the deposit will not be refunded. In the event that Nathan Sixsmith Photography cancels the booking, 100% of the deposit will be refunded.
Payment: A 50% deposit is required to confirm your booking. The remaining balance is due before the delivery of your photographs. Payments can be made via bank transfer. Payment details will be provided on your invoice.
Delivery of Images: All clients are offered digital downloads of their photos via Google Drive or the Nathan Sixsmith Photography website. Edited images will be delivered within 2-6 weeks of the session or wedding date. Please note that Google Drive links will remain active for 12 months from the date of delivery, and website galleries will remain active for 14 months from the date of delivery. Clients are encouraged to download and back up their images before these periods expire as Nathan Sixsmith Photography cannot guarantee access to images after these timeframes. USB drives containing digital images can be provided for an additional fee of $60 (including postage). There is no USB fee for wedding bookings of 6 hours or more, unless additional USB drives are requested. Please allow 2-6 weeks for USB delivery unless it can be dropped off locally.
USB Drives: USB drives are provided as a physical backup only and are supplied with no warranty once delivered. Nathan Sixsmith Photography is not responsible for USB drives that are lost, damaged, or fail after delivery, and recommends clients copy the contents to a computer or external storage as soon as possible. The USB drive should not be relied upon as a sole backup.
Weather Policy: Weather is outside of anyone's control and Nathan Sixsmith Photography will always do their best to work with the conditions on the day. In the event of severe weather that prevents an outdoor session from proceeding safely, the session may be rescheduled to a mutually agreed date. Please note that light rain, wind, or overcast conditions are not grounds for rescheduling — these conditions can often produce beautiful and unique results. For weddings, Nathan Sixsmith Photography will adapt to whatever the day brings. If a couple wishes to reschedule their couple portrait session due to weather, this can be arranged at an additional cost.
Late Arrival: Your booked session begins at the agreed start time. If you arrive late, your session will still conclude at the originally scheduled end time unless a prior arrangement has been made. Nathan Sixsmith Photography will not be held responsible for missed shots or reduced coverage as a result of late arrival.
Force Majeure: In the unlikely event that Nathan Sixsmith Photography is unable to attend your booking due to illness, injury, family emergency or any other circumstances beyond their control, Nathan Sixsmith Photography will make every effort to find a suitable replacement photographer of comparable skill and style. If a replacement cannot be sourced, a full refund of all monies paid will be provided. Nathan Sixsmith Photography's liability is limited to the refund of payments received and no further compensation will be provided.
Limitation of Liability: Nathan Sixsmith Photography carries backup camera equipment on the day and keeps backup copies of client images during the editing and delivery process, to minimise the risk of data loss. In the unlikely event of equipment failure, data loss, theft, or any other circumstance resulting in lost or undelivered images or footage, Nathan Sixsmith Photography's liability is limited to a refund of payments received for the affected portion of the booking. Nathan Sixsmith Photography is not liable for any further loss, damages, or compensation beyond this refund.
Online Uploading: Unless the client has clearly stated they do not wish for their photographs to be shared online, all photos deemed appropriate and of high quality may be uploaded to social media and the Nathan Sixsmith Photography website for promotional use.
Marketing & Promotion: Nathan Sixsmith Photography may reproduce images from a client's session for marketing, advertising, promotion and exhibition purposes. Nathan Sixsmith Photography fully respects a client's wish to keep their photographs strictly private — please inform us before or at the time of booking.
Model Release: By engaging Nathan Sixsmith Photography, the client grants Nathan Sixsmith Photography a non-exclusive, royalty-free licence to use the photographs for promotional, marketing and portfolio purposes including but not limited to social media, website display, print advertising and exhibition. Clients who do not wish their images to be used in this way must notify Nathan Sixsmith Photography in writing prior to the session.
Copyright and Image Ownership: All photographs taken by Nathan Sixsmith Photography remain the intellectual property of Nathan Sixsmith Photography. Clients are granted a personal use licence to save, share, and display their images digitally. Images may not be used for commercial purposes without prior written permission. Nathan Sixsmith Photography does not provide unedited RAW files under any circumstances.
Editing Style: The editing style and creative decisions of Nathan Sixsmith Photography are the photographer's own. Clients who book Nathan Sixsmith Photography do so based on the style of work displayed in the portfolio. Requests to replicate the editing style of another photographer may not be accepted. Minor adjustments may be requested and considered at the photographer's discretion.
Second Shooter: Where a second shooter is engaged to assist at a booking, they will operate under the same Terms and Conditions as Nathan Sixsmith Photography. All images captured by a second shooter remain the property of Nathan Sixsmith Photography.
Material Photographed: Nathan Sixsmith Photography is not liable for anything that is photographed incidentally. Requests for specific images to be removed should be made via the contact page on the Nathan Sixsmith Photography website. Removal requests will be actioned as soon as possible. Images not delivered to the client no longer exist after the editing process is complete — please do not request photographs that have not been provided.
Quantity and Quality: Nathan Sixsmith Photography takes a high volume of photographs to ensure the best possible quality. Not all images taken will be delivered. A failure to deliver any specific image shall not constitute a breach of this agreement and shall not result in a refund or any other remedy.
Behaviour and Safety: Nathan Sixsmith Photography has the right to leave a booking at any time without notice if they feel their personal safety or the safety of their equipment is at risk. If equipment is damaged by a guest — for example by liquid being spilled on a camera — no refund will be issued. Nathan Sixsmith Photography also reserves the right to leave if subjected to aggressive, abusive, or inappropriate behaviour from the client or their guests. In such circumstances no refund will be provided.
Exclusivity: The client agrees that Nathan Sixsmith Photography holds exclusive rights to photograph the event. Should another photographer be present and photographing the event in a professional capacity without prior agreement, Nathan Sixsmith Photography reserves the right to leave and no refund will be provided.
Travel: Travel: Travel within the South West, Mandurah, south of the river Perth suburbs, Perth CBD, and UWA is included at no additional cost. For all other north of the river Perth locations a travel fee of $150 applies. For locations further afield please enquire for a custom travel quote. Accommodation costs for destination weddings or events requiring an overnight stay are to be covered by the client.
Privacy: All personal information provided during the booking process will remain strictly confidential and will not be shared with any third party without the client's knowledge and permission.
